CONDEMNING THOSE WHO DECLARE TO BE CITIZENS OF THE FREE TERRITORY OF TRIESTE

On 10 August 2015 the Court of Trieste condemned a man who declared himself a citizen of the Free Territory of Trieste. So far this decision is the lowest of the local judiciary.

Only a few days later, the same judge issued another decision (No. 784/15 of 8 September 2015) confirming the hatred of Italian judicial authorities any citizen who opens Question Trieste.

We are talking about some “hanging judge”. It is no coincidence that it is him judging the citizens who claim their rights established by law: they are harmless when facing the Italian State or its local representatives. The state of fact, consisting in a simulation of sovereignty, which goes as far as affecting the judiciary, but goes also against the rule of law: supported by the citizens of Trieste: this is what is happening in the capital city of the Free Territory.

Since 1954, Trieste and its international Free Port are entrusted by the Governments of the United States of America and of the United Kingdom to the responsibility of the Italian Government (not to the Italian State) under a mandate of temporary civil administration. Administration does not mean sovereignty.

This temporary civil administration must grant the citizens of the Free Territory an independent judiciary. The judges appointed by the provisional Italian Government must comply with Trieste’s laws, which are either updated or extended by the Commissioner of the Government.

But things are not the way they should be.

Since 1954, Trieste endures nationalistic propagandas that only serve as excuses to deprive it of its legitimate rights for the sake of a small lobby. It is the local nationalistic camorra. In exchange for simulating Italian sovereignty over Trieste, this gang of Italian nationalists enjoys its own realm. And it exploits such realm without shame (eg. polluting its environment. I investigated this problem and wrote about it in my investigative book “Tracks of Legality“).

The Court of Trieste is the stronghold of this degradation of officers and authorities.

I have seen it first hand, even outside the investigations about pollution in the present-day Free Territory. I am the first citizen of Trieste to lodge an exception on jurisdiction, asking the local judiciary what authority it exercises (LINK).

Judges who claim they exercise Italian sovereign jurisdiction instead of the Free Territory’s are incompatible with Trieste’s legal status. Since 1947 Trieste is an independent State.

I rejected the judges who, in spite of their own laws and of the Italian Government’s provisional administration, rejected my legitimate request to stand trial in accordance with the Free Territory’s own legislation. I was also punished with court fees for doing so.

This is what happens to those who won’t ben the knee to the lies of the local nationalistic camorra. This is the punishment for refusing to become an accessory to State crime that makes few wealthy at the expenses of all others.

Retaliatory punishments and complete repression at the hand of the judiciary.

And this is the illegal policy at the core of judge Massimo Tomassini’s decision against one of Free Trieste’s associates, found “guilty” of declaring himself a citizen of the Free Territory, and asking respect for it.

The judge in question is the same the people contested in July 2013, during a public hearing. I was the one standing trial, and of course I exercised my rights as citizen of the Free Territory. It was the judge’s own attitude to provoke the protest of those people (LINK).

The incident unleashed an intimidation campaign, happily supported by local newspaper “Il Piccolo”.

It feels like going back to the harsh Fascist era: in this land, it lasted 25 blood-stained years, and people were forbidden from showing their own identity.

Now, in 2015, in Trieste, whoever claims the rights established under the 1947 Peace Treaty is still persecuted and condemned. No longer by the judges of the Fascist Special Courts but by the “special” (because they deny their own jurisdiction) Courts of the Italian Republic.

It is not surprising that judge Massimo Tomassini convicted Free Trieste’s supporter as harshly as he did. He wanted to show the usual violence of a State used to act with ruthless, antidemocratic violence. This is Italy’s Fascist legacy.

This citizen had a clean criminal record. Until he declared himself a citizen of the Free Territory of Trieste, opposing to an illegitimate inspection by the Guardia di Finanza (or GdF. It is the Financial Police. It collects taxes in the name, on behalf, and in the budgets of the Italian Republic. Often, it is undue Italian taxes, incompatible with Trieste’s legal status).

Long story short, this person is before Court, guarded by the Carabinieri. The trial ends with a political decision: the judge outright states that he is punishing this “rebellious” citizen because he denied Italian sovereignty over Trieste.

It is surreal, but not unusual.

Italian organized crime plunders and deprives Trieste of its rights.

It is worth referring the reasons of this conviction, which goes against any legal principle and logic:

“The [omissis – citizen’s name] refused to provide his identity to the soldiers of the GdF not out of rudeness, or simple hostility, rather, out of a purely ideological choice, namely, the belief that he has no reason to comply with a legitimate order of a Public Authority because of his citizenship, not Italian, but of the free territory of Trieste.

Now, trusting that this judge won’t ever stop repeating that Trieste is Italy; that in this city the only jurisdiction that matters is Italian; that the only law in force is Italian;

that the only Public Security Forces worth this name are Italian; and, therefore, there is absolutely no room for any other self-proclaimed authority –

all while considering it worthless at the same time, it is not even worth wasting time refuting the claim about there being, here in Trieste, some unspecified free territory of Trieste…-,

…it seems very clear that someone claiming the right to refuse identifying themselves to a public officer who belongs to the GdF and is legitimately asking it is a lot more serious than an identical behavior enacted, for instance, due to being in an euphoria, because would mean being driven by anger or, again, acting on a personal trait like rudeness.

Indeed, when someone decides to act with the behaviour in question due to not recognizing the Italian State’s sovereignty or the authority of its Public Security Forces, obviously such a behavior cannot be regarded as “not so serious”, because its core motivation is hostility against the only legitimate Law, and this absolutely cannot be underestimated, on the contrary, it requires a fitting criminal sanction”.

This judge, who doesn’t recognize the 1947 Treaty of Peace considers it necessary convicting a citizen of the Free Territory who claims his own rights. Rights that are even granted by Italian laws, including the Italian Constitution.

Trieste does indeed bear a burdensome Fascist legacy. However, with some luck, the Free Territory’s future doesn’t depend on the Italian Government alone…
