“any course of European, national, regional or administrative (local) elections held and summoned in the FTT by either Italian or European authorities constitutes a violation of international law and, at the same time, a breach of the Italian legal system”.

The opposition to Italian elections summoned and held in the present-day Free Territory of Trieste has very strong legal bases. In particular, art. 21 of the 1947 Italian Peace Treaty ended Italian sovereignty over Trieste. Since September 15th, 1947 the city is the capital of a Free State.

From 1947 to 1954, the British-US Allied Military Government of the Free Territory of Trieste – AMG FTT, acting as first provisional Government of the new State on behalf of the UN, ruled Trieste with own legislation, including about elections: LINK

The people of Trieste have the right to vote their own representatives under their own law, not representatives of any other State, including Italy.

Under the 1954 Memorandum of Understanding regarding the FTT, the Governments of the US and of the UK confirmed, once again, the sovereignty of the Free Territory by sub-entrusting its administration to the Italian Government in compliance with the Peace Treaty and in continuity with the AMG FTT.

This means that the Italian Government and its officers have no right to summon Italian elections in the Free Territory of Trieste simulating Italian sovereignty over it.

Italy is another State. Its EU membership does not affect the Free Territory of Trieste, which was never officially associated to it. Furthermore, under the 1947 Peace Treaty (Annex VI, art. 24.4):

Economic union or associations of an exclusive character with any State are incompatible with the status of the Free Territory.

Even the EU, answering to a petition of mine, confirmed that the legal status of the Free Territory does not fall within the scope of Community law.
