Trieste: the Commissioner of the Government and the special trusteeship mandate

She needs to exercise the temporary civil administration over the Free Territory.

Trieste, April 7th, 2015. – On March 6th, Free Trieste initiated its «Campaign of fiscal liberation of the citizens and enterprises of the Free Territory of Trieste».

The Movement is now requesting the Commissioner of the Italian Government in Region Friuli Venezia Giulia to exercise her legislative powers, inherited from the previous Commissioner General in charge of administering the Free Territory of Trieste.

It is the special trusteeship powers previously exercised by the A.M.G. F.T.T., sub-entrusted to the Italian Government in 1954 with the MoU regarding the Free Territory.

The Italian Government appointed a Commissioner General as its representative in Trieste. Since 1963, it is the the Commissioner of the Government in the Region to exercise the Commissioner General’s powers.

In particular, it is powers regarding the Fondo Trieste and the international Free Port, as recently admitted (December 30th, 2014) by the current Commissioner: Ms. Francesca Adelaide Garufi.

This is why Free Trieste requests the Commissioner to issue decrees declaring the legal inefficacy of the judgements No. 530/2013 of the Regional Administrative Court and No. 1350/2014 of the Italian Council of State. Indeed, both decisions reject as unfounded and even label as “subversive” the Movement’s request to cancel the 2013 regional elections.

The Movement argues that Italian authorities have no jurisdiction over Trieste; the Italian Government does, but only as the Free Territory’s provisional Government, under a UNSC special trusteeship mandate.

Free Trieste is now asking the Italian Commissioner to either exercise her special trusteeship powers, confirming the legal status of the Free Territory of Trieste, or to deny to have such powers. The latter would mean she cannot “move away” the Northern Free Port’s regime, or issue other legal measure.
