17 April Referendum against Oil Drilling: vote in Trieste not legalized yet

Trieste, 14 April 2016. – The Commissioner of the Italian Government, delegated to exercising the present-day Free Territory of Trieste’s temporary civil administration, has yet to issue the decree needed to extend the Italian Referendum of 17 April concerning oil drilling in the Adriatic Sea to the provisionally administered Trieste.

The Free Trieste Movement has been requesting such a Decree since as early as 18 March, because without this legal legitimation, the vote of the people of Trieste would be null and void, and it may invalidate the whole Referendum.

Allowing the people of Trieste to express valid votes in this Referendum is important because the environmental risks of oil drilling it Italian national waters do also extend to those of Slovenia, Croatia and the present-day Free Territory of Trieste, entrusted to the Italian Government under a special trusteeship mandate since 1954.

Instead, an illegitimate vote would violate the international and constitutional constrains of the Italian Government and of the State of Italy towards the Free Territory of Trieste.

Free Trieste underlines that is it specific obligations in force, established with the Treaty of Peace with Italy of 10 February 1947 and with the Memorandum of Understanding of London of 5 October 1954, both implemented in the Italian Constitutional and legal and recently confirmed by the United Nations with document S/2015/809 of the Security Council and General Secretary.

Considering that the Commissioner of the Italian Government exercises, since 1954, said powers of temporary civil administration of the Free Territory of Trieste also in regard to the international Free Port and electoral matters, Free Trieste invites her to fulfill, before the opening of polling stations, her obligation to issue the decree for the extension of the Referendum.

Otherwise, the Commissioner must take full civil and criminal liabilities for refusing and avoiding to perform an act of her official duty (art. 328 Italian Criminal Code).
