Many are interested in the fact that there is no such body as an Italian province of Trieste.
I already wrote about this in a post and it received much attention.
The Italian Province of Trieste ceased to exist on September 15th, 1947, when the Treaty of Peace with Italy came into force: indeed, Italy could no longer have administrative bodies in a news State, the Free Territory of Trieste. The new Province of Trieste is an homonymous, different body established under the laws of the Free Territory (Order No. 259 of 1948).
This is also true for the Trieste Court of Appeal: it is no longer a District Court of the Kingdom of Italy. It is the Court of second instance of the Free Territory of Trieste.
In 1954, when the Italian Government was sub-entrusted with the administrative powers of the British-US AMG FTT under the MoU regarding the Free Territory of Trieste, it committed to continue the temporary civil administration of once “zone A” of the Free Territory and of Trieste’s international Free Port under the Italian Peace Treaty (which remained unchanged).
Obviously, we would not be here if the Italian administration had complied with its mandate; unfortunately, things didn’t go that way. Had it been, the international Free Port of Trieste would be the main Mediterranean and the Free Territory would be the Singapore of Europe.
Instead, the officers in charge of Trieste’s temporary civil administration started simulating Italian sovereignty over Trieste and over its Port (despite that ending in 1947).
Their main lie is the Free Territory has never existed as a State. To disprove this lie, it is enough reading art. 21 of the 1947 Treaty of Peace. This includes a list of States that recognize the Free Territory of Trieste. And the list includes Italy.
One year after another, one lie after another, the local establishment established a system of corruption that simulates Italian sovereignty over the Free Territory and over its international Free Port in the name of anacronistic nationalism. This simulations harms not only the rights of the people of Trieste, but also the rights of the International Community of States. This simulation consists in attempts do deny or to get rid of evidences of the Free Territory’s very existence: on one side with anacronistic nationalistic propagandas, on the other, trampling on the laws.
Some telling examples are the forceful attribution of Italian citizens to the people of Trieste, the obligation to serve in the Italian army, the collection of the enormous Italian taxes in the Free Territory of Trieste, the questionable management of the Free Territory’s assets of State and, of course, the summoning of elections under Italian laws, despite the Free Territory having its own laws. Speaking of it: the Decree at the article’s end is rather meaningful.
The same authorities that should have protected those rights have broken them all. An action worth the Fascism regime, which, in a sense, has never been fully defeated here. Trieste is still a conquered land in the eyes of Italian nationalists and Italian mafias.
However, history cannot be cancelled, only falsified. This is how the traces of the “system’s” crimes against the Free Free Territory, one day after another, return to light thanks to the work of the people who stand for the rule of law in this forgotten State.
The best part? It is not just any evidence, it is laws of the Italian State. It is proof that Italy recognizes the Free Territory of Trieste. If Law is still the foundation of a civil society, if the current legal order is still be based on international law, then Italy shall come to terms with its dark side. Because its very officers regard international treaties as scrap paper, disregard its very Constitution, and ignore law and order.
