The underwritten, as citizen residing in the Free Territory of Trieste, underlines that measure No. 37561/2013, Art. 11, sub-paragraphs 2 and 3 of Decree-Law No. 201, dated December 6th,  2011, reverted and modified with Law No. 214 of December 22nd, 2011 “Methods for the annual submission of the archive of financial records” cannot be extended to the Free Territory of Trieste due to the obligation deriving from international agreements concerning said territory.

When it became independent, the Free Territory of Trieste obtained not only international recognition (and the right to join the UN). It received also the recognition of its own monetary sovereignty (Annex VI, Art. 30, 1947 Treaty of Peace).

That Treaty is in force, and because of this, Trieste is a State outside EU financial laws. Therefore, it is also free from the ECB and its connected Banca d’Italia: a new frontier for global economy.

Of cause, this applies also to the International Free Port of Trieste, the Free Territory’s main State corporation (Annex VI, art. 34). Monetary sovereignty means the right to have our own currency and our own stock exchange. And this would greatly benefit the international Free Port’s development.

Until their own currency is established, the people of the Free Territory enjoy the guarantees set in the Treaty of Peace (Annex VII, art. 11). Which means, Italian currency is only a provisional measure, and follows an agreement between Italy and Trieste (it was signed in 1948).

Another economic provision set with the Treaty of Peace is the Free Territory of Trieste’s exemption from the payment of the Italian public debt (Annex X, Article 5). Therefore, the Free Territory of Trieste and its international Free Port cannot be subject to Italian taxation either.

The 1947 Peace Treaty is an upper-ranking international law: Italy must comply with it, and so does the European Union, (priority of pre-existing treaties).

Only the local officers in charge of Trieste’s temporary civil administration seem to have forgotten about it, yet, all citizen of the Free Territory can claim their rights.

How can we claim our State’s monetary sovereignty? Questioning, even individually, the forceful application of Italian and EU economic laws. Starting with the credit institutions which enforce these laws.
