Trieste summons Rome before Court
for applying the VAT
Press release by the I.P.R. F.T.T.
Tuesday, December 4th, at 11.30 AM, in the press room of Piazza della Borsa 7 (mezzanine), the International Provisional Representative of the Free Territory of Trieste – I.P.R. F.T.T. presents to the press the newly initiated civil legal action against the Italian Government and its tax agencies for determination of the inapplicability of the VAT in Trieste.
The writ of summon, notified on November 21st and registered at the Court of Trieste on November 29th with No. 4277/2018, summons before Court the Office of the President of the Council of Ministers of the Italian Government, the Italian Ministry of Economy and Finance, the Tax Revenue Office, and the Customs and the Customs and Monopolies Agency.
The legal action is based on the European and Italian laws in force about the Value Added Tax, which prevent its applications on the supply of goods and services, as well as on imports that take place in the present-day Free Territory of Trieste, sub-entrusted to the temporary civil administration of the Italian Government.
Before the Court of Trieste there are four pending legal actions initiated by the I.P.R. F.T.T., and their value amounts to several billion Euro: this new legal action regarding the VAT, but also legal actions No. 1757/17 about taxation (now before the Court of second instance, No. 941/18 about the ownership of the Northern Free Port, and No. 2370/18 regarding ownership of all other State assets in the administered Free Territory.
