Trieste, 10 February 2018: press conference of the I.P.R. F.T.T. about the new expertise regarding the recognition of the present-day Free Territory of Trieste and of its international Free Port in Italian Law
On Saturday 10 February, on the anniversary of the signature of the 1947 Treaty of Peace that established the Free Territory of Trieste and its international Free Port, the I.P.R. F.T.T. – International Provisional Representative of the Free Territory of Trieste is holding a press conference to present, in English and in Italian, the new, decisive legal expertise of the I.P.R. F.T.T. Law Commission on this subject.
While the previous expertise, published in 2016, had clarified the question on the level of international law, disproving all theses against it, the new one does carefully review, through 63 pages in the Italian version and 74 pages in the international edition in English «The Italian Corpus Juris that ratifies and enforces the international legal obligations of the Italian Republic and of the Italian Government respect to the present-day Free Territory of Trieste and the consequent obligations respect to other State and the United Nations» with laws since 1947 (and others referring to it at least until 2020).
This new analysis revolutionizes all previous discussions on the matter, because it proves that the legal order in force of the Italian Republic does as well recognize the present-day Free Territory of Trieste as independent State sub-entrusted to the temporary civil administration of the Italian Government by the Governments of the United States of America and of the United Kingdom of Great Britain and Northern Ireland, for their role of primary administrators on behalf of the UN Security Council.
Consequently, all political thesis with which certain circles and officers of the provisional Italian administration in Trieste attempted to simulate that, instead, the Free Territory of Trieste and its international Free Port were subject to the sovereignty of the Italian State lack legal ground, and the consequent acts are unenforceable, null and void, because they constitute the irremediable, logical-legal contradiction to attempt enforcing a legal system by breaching it.
The I.P.R. F.T.T. has already lodged the new expertise in its lawsuit, activated on 22 May 2017 versus the Italian Government, its Fiscal Agencies, and the INPS to ascertain the fiscal rights of the present-day Free Territory of Trieste and of its international Free Port. More than 500 citizens and enterprises have already joined the legal action, while the Italian State’s Legal Service (Avvocatura dello Stato) has not tried to defend opposite claims.
In the next few days, the new expertise will be notified to all Authorities that exercise the Italian Government’s provisional administration in Trieste, and it will be published in Italian and in English.
