Port of Trieste: denounced grounds of nullity of the tendering procedure for tug services

Trieste, 31.VIII.2015. – The Harbor Master’s office of Trieste opened Europe-wide tendering procedures to assign tug services in the port of Trieste for the next 15 years, which results to have interested local enterprise Tripmare and Danish company Svitzer.

The Free Trieste Movement notified to the Harbor Master’s office an act of “public warning” dated 29 August, which denounces the reasons why both the tender and its outcome could be impugned for original absolute nullity.

The purpose of the act is preventing legal disputes that would damage the Port of Trieste. Due to this, the document was also sent, for information, to the known competitors – Tripmare and Svitzer –  as well as to the Italian Port Authority in Trieste ant to the Commissar of the Italian Government in Trieste, but also to the President of the European Parliament, in regard to a pertinent, international dispute procedure.

According to the act, the Italian Harbor Master’s office in Trieste ceased to exist in 1947, with the establishment of the Free Territory of Trieste by virtue of the Treaty of Peace, and hasn’t been re-established since by either the Free Territory or Italy.

Due to this, its acts would be null and void, while the enforceability of European Laws results to be under examination before the European Parliament upon a petition of the Free Trieste Movement itself.
