WHO SHOULD DEFEND THE CITIZENS OF THE FREE TERRITORY OF TRIESTE AS THEY FACE THE PERSECUTION OF LOCAL ITALIAN AUTHORITIES? FIRST HYPOTHESES FOR POLITICAL ASYLUM.

It’s been one year since I denounced the Italian judges and officers responsible of breaching the 1947 Treaty of Peace at the expenses of the Free Territory of Trieste and of its citizens. I did it reacting to adminsitrative judgment 530/2013. The Regional Administrative Court for Friuli Venezia Giulia (T.A.R. F.V.G.) issued the judgment in October 2013.

In this decision, the T.A.R. F.V.G. rejected my appeal against the illegal summoning of the 2013 Italian regional election in the Free Territory of Trieste. However, the Administrative Court did more than this, and more than an Administrative Court should.

Crossing in the field of criminal law, the administrative judges charged me with subversion. What did I do to deserve it?

I sought justice before Court: I exercised my civil rights. As a citizen of Trieste, I sought the re-establishment of the rule of law. I sought the settlement of Question Trieste. I demanded laws in force be respected, first and foremost the 1947 Peace Treaty, which makes Trieste an independent State. The Free Territory of Trieste.

The administrative judgment was embraced by the whole local Italian judiciary, in an attempt to deny the rights of Trieste’s citizens: intimidating, repressing them. This is why I denounced them:

“for the alleged offenses embodied in the Italian legal system as abuse of judicial functions committed by certain magistrates of the Republic of Italy, and by third parties in order to be committed, for political motives and in association with third parties, of offense meaning international crimes and of other crimes against the FTT – Free Territory of Trieste/Territorio Libero di Trieste, against its legitimate, provisional government, against the rights and legitimate interest of its citizens and of other subjects holding said rights, as well as of the committed offenses of slander, of threaten, of defamation and of endangering the safety of people and endangering public order for the citizens mentioned before;

all of this in subversive violation of the democratic, Constitutional legal order of the Republic of Italy and in violation of Law No. 17/1981”,

Presented by Roberto Giurastante, born in Trieste on March 24th, 1965, citizen of the FTT under temporary civil administration of the Italian Government, versus the subjects identified and in the complaint and of these yet to be identified) was addressed to the Italian judicial authority (Procura di Bologna – Bologna Public Prosecutor, competent for the investigations on magistrates of the Court of Trieste), to the Italian Government, and to the Trusteeship Council of the United Nations.

It’s been one year. I am waiting for an answer, all while the local Italian authorities, in spite of the law, intensify their intimidations against those who keep calling for the rule of law.

A rule of law violated, one day after another, by the shameless local officers and administrators. Instead of exercising the correct temporary civil administration of the Free Territory of Trieste, they simulate Italian sovereignty. And to protect their own illegal actions, they shield in anachronistic nationalism.

Now, I will send the complaint forward to the Signatory States of the Treaty of Peace. Demanding their intervention in defense of all the citizens of the Free Territory. And I will do it as a person politically persecuted.

In the silence of the Italian Government, temporary civil administrator of the present-day Free Territory, it is permitted that the citizens of Trieste are persecuted by a nationalist lobby willing to destroy not only Trieste, but also its precious international Free Port.

An international crime that could not remain unpunished. The citizens of Trieste have the right and duty to address, in accordance with international law and with the UN Charter, not only the UNSC, but also the Allied Powers. They are the signatories of the Treaty of Peace after all. Italy, the defeated Country, is responsible to them.

It is fundamental re-establishing the rule of law, violated by the local representatives of the the Italian Government.

The citizens of the Free Territory who are persecuted by this local nationalistic system can seek support and political asylum addressing the Allied Powers, to the UNSC, to UN Member States which recognize the 1947 Treaty of Peace.

However, political asylum should be granted within the Free Territory itself, and until the rule of law is restored.
