Trieste: the Court is requested to void
Municipality-Region contracts regarding the “old Port”.
Trieste, 28.09.2023. – On September 27, 2023 Agency I.P.R. F.T.T. – International Provisional Representative of the Free Territory of Trieste presented the Land Registry Office with an act requesting the Court of Trieste to void the 11 July Decree with which the Land Registry Judge registered in the Land Registry Book a sale by direct agreement from the Municipality of Trieste to Region Friuli Venezia Giulia.
The sale regards four storehouses of the so-called “old Port” of Trieste, purchased by the Region to transfer its own offices there, tendering the due works for further EUR 140 million, resulting in a EUR 67 million deficit.
The request to void those sales operations is part of a 30-page analysis included within a Land Registry Dispute based on fact and law, it has 9 annexed documents, and it is currently recorded and publicly accessible at the Trieste Land Registry Office under GN 10951/23. The act states that the sale by direct agreement from the Municipality to the Region is unfit for record within the Land Registry Book, because it constitutes a manifest breach of national and Community laws, under which those State-owned assets can only be auctioned within the European system. For this reason, the case cannot be resolved without a preliminary ruling of the EU Court of Justice.
According to the I.P.R. F.T.T. the operation is the result of illegitimate, official agreements concluded in Trieste by Mayor Roberto Dipiazza, Regional President Massimiliano Fedriga, and the President of the Port Authority Zeno D’Agostino for the purpose of giving the assets of the s.c. “old Port” destinations that are not permitted by the law and damage the international Free Port, taking advantage of the local judiciary’s active and passive protections, which the act exposes as it calls for «suitable investigations from the competent authorities».
